Terms of Service (TOS)
1. Eligibility
You must be at least 18 years old or of legal age in your jurisdiction to use our Services. By using the Suredeal product, you represent that you meet these requirements.
2. Account Registration
To use our Services, you must create an account. You agree to:
- Provide accurate and up-to-date information.
- Keep your login credentials secure.
- Notify us immediately of unauthorized access.
You are responsible for all activity under your account.
3. Use of Services
Stendler Incorporated provides tools for generating sales estimates, quotations, and related business documents. You may use our Services only for lawful purposes and in accordance with these TOS. Prohibited activities include, but are not limited to:
- Using the Services for fraudulent, illegal, or harmful purposes.
- Generating misleading or false estimates.
- Spamming, harvesting user data, or unauthorized marketing.
- Attempting to access other users’ accounts or data without authorization.
- Interfering with the security or performance of the platform.
We reserve the right to suspend or terminate accounts that violate these rules.
4. Payments, Billing, and Refunds
All payments for subscriptions and purchases are processed through Paddle, our payment processor, which acts as the Merchant of Record. By subscribing or making a purchase:
- You agree to Paddle’s Terms of Service and Privacy Policy, in addition to these TOS.
- Subscription fees are billed in advance, based on your chosen plan, and may include applicable taxes.
- Your subscription continues until cancelled.
Refund Policy
- Refund requests must be submitted within 14 days of the initial subscription purchase.
- Refunds may be granted if the Service has not been substantially used.
- Refunds are processed through Paddle; timing depends on your payment method and Paddle’s processing.
- Requests after 14 days, for renewed subscriptions, or for additional services/third-party integrations are not eligible for refunds.
Note: As Paddle is the Merchant of Record, all refunds, chargebacks, and payment disputes are handled by Paddle. Stendler Incorporated is not responsible for payment disputes or failures.
5. Intellectual Property
- Copying, modifying, distributing, or creating derivative works without permission is prohibited.
- Use of our trademarks or logos for commercial purposes requires consent.
6. Data and Privacy
You retain ownership of the data you input into the SureDeal product. By using the Services, you consent to our Privacy Policy below.
While we use commercially reasonable efforts to protect user data, we do not guarantee complete security. You are responsible for maintaining backups and safeguarding your account credentials.
7. Disclaimers
- The Services are provided “as-is” and “as available”.
- Stendler Incorporated does not guarantee accuracy, completeness, or reliability of estimates generated.
- The Services do not constitute legal, financial, or professional advice.
- We do not guarantee uninterrupted access, and service may be subject to delays or outages.
8. Limitation of Liability
- Stendler Incorporated and Paddle shall not be liable for indirect, incidental, special, punitive, or consequential damages.
- The maximum aggregate liability is limited to fees paid by you in the 12 months preceding the claim.
9. Indemnification
- You agree to indemnify, defend, and hold harmless Stendler Incorporated, its affiliates, and Paddle from any claims, damages, losses, or expenses arising from your use of the Services, violation of these TOS, or infringement of third-party rights.
10. Force Majeure
Stendler Incorporated and Paddle are not liable for delays or failures caused by events beyond their reasonable control.
11. Termination
We may suspend or terminate your account for violations of these TOS or applicable law. Upon termination, your access ends, but accrued rights and obligations survive.
12. Governing Law
These Terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in the courts of Ontario.
13. Changes to Terms
We may update these TOS from time to time. Changes take effect when posted. Continued use of the Services constitutes acceptance of the revised terms.
